1. General
1.1. This page and all pages that refer to Pomme Equestrian AB’s (Pomme) general terms and conditions (the “Terms”) apply when you as a consumer (“you”) place an order via www.wearepomme.com and associated pages, (the “Website”). An agreement is reached between you and Pomme Equestrian AB, 559203-5579. Detailed contact information and other information about Pomme can be found on the website. By using the website you show that you agree to these terms and conditions and if you do not accept or accept the terms, you should stop using the site.

1.2. Pomme reserves the right for out of stock as well as any image and writing errors on the Site, such as errors in product description or technical specification, incorrect prices and price adjustments (such as changed prices from suppliers or currency changes) or incorrect information regarding an item being in stock. Pomme has the right to correct such errors and to change or update the information at any time. If an incorrect price has been stated for an item that you have ordered, Pomme will of course notify you and await your approval of the corrected price before Pomme continues with the order. All images on the Site should be viewed exclusively as illustrations. Such illustrations cannot be guaranteed to represent the number of goods you receive or the exact appearance, features or origin of the goods. Pomme is not responsible for information on the Site that comes from a third party.

1.3.The website, as well as all content on it, is owned by Pomme or its licensors. The information is protected by, among other things, intellectual property and market law. This means that trademarks, company names, product names, images and graphics, design, layout and information about goods, services and other content may not be copied or used without written approval from Pomme.

1.4. To be able to trade with an invoice or part payment as a payment method you must have reached the age of 18. Pomme reserves the right to deny or change your order in individual cases (for example, if you have provided incorrect personal information and / or have record of non-payment).

2. Contract and order
2.1. In order to make a purchase via the site you must accept the General terms and conditions. By accepting the General Terms and Conditions you commit to follow them in its entirety, along with Pomme’s Privacy Policy regulating the use of your personal data.

2.2. A purchase agreement is effective only when Pomme confirms your order, and you receive the order confirmation from Pomme by email. Pomme encourages you to save this order confirmation for any contacts with Pomme’s customer service. You can revoke your order until it has been confirmed by Pomme. If the order is revoked Pomme will refund any payments that you or your debit or credit card provider have made regarding the order.

3. Prices, fees and payment
3.1. Prices are quoted in local currency and include VAT. The prices do not include any potential payment or shipping charges, which are stated separately in the checkout.

3.2.You can pay with Klarna in the ways specified on the website. Pomme has the right to charge already in connection with the order, unless invoice payment or other similar payment method has been chosen by you and approved by Pomme. In case of invoice payment or part payment, Pomme or its partners may make a credit record. You will be informed in this case. Pomme reserves the right not to always offer all payment methods, or change the payment method if what you have chosen for any reason does not work at the time of purchase. 4. Promotions and offerings
4.1. Pomme may from time to time offer promotions on the web page that may have more favorable terms than indicated by the General terms and conditions, e.g. regarding payment or extended return right. These preferential terms apply as long as the promotion is active and for the specific products specified by Pomme in connection with the promotion. Pomme reserves the right to revoke such promotions at any time. Upon termination or revocation of a promotion, the General terms and conditions apply without modification. Offers on specific goods on the website are valid for a limited time and as long as the inventory lasts.

5. Delivery and transport
5.1. Pomme strives to ship your order within one to two business days from the time you receive your order confirmation. Please note that it may take longer if it is a sale, other unexpected events or depending on product availability.

5.2. You will receive delivery information via email when your order has been sent from us with an estimated time for delivery.

5.3. The shipping method depends on your country of residence. The cost of shipping depends on which shipping method you choose. You will find different options for your country at checkout.

5.4. For orders with a value in excess of 100 EUR, no freight cost is charged for the standard freight option. For orders with a value lower than 100 EUR, a freight cost will be charged. The size of the shipping fee depends on the chosen shipping method and will be clearly shown in the total cost at checkout.

5.5. You must enter correct and complete address information in your order as we cannot guarantee that it can be changed after you have completed your purchase. The customer is solely responsible for any delivery errors due to a lack of information or errors on the delivery address in the order.

5.6. If the package is to be collected it must be done within the time specified in the notification. Packages should normally be collected in person with valid identification and order number. You always get a notification that shows where and when the package is to be collected. Notification can be made via e-mail, regular mail and if you have provided a mobile number, also SMS. If du do not collect the package and it is sent back, Pomme has the right to charge you a fee of 15 EUR.

5.7. Our carriers will make every effort to deliver your order within the promised delivery time. However, delays are sometimes inevitable. If you have not received your parcel within the promised delivery time, please contact our customer service. If your order is not delivered within the promised time frame, we will inform you as soon as possible, the reason for the delay and the new delivery time. If the delivery time has been of significant importance, you have the right to cancel the order free of charge.

6. Withdrawal
6.1. Pomme offers 30 days return right from the day you received your order. The product must be in its original condition and must not be used or washed. All labels must be left on the item.

6.2. If you want to return or exchange an item, follow the instructions included in the package, or on Pomme’s website. In order for Pomme to handle the return, the return form must be completed correctly.

6.3. If you return an item, it is important that you save your receipt on the return freight as you as a customer are responsible for the goods until they reach our warehouse. If you miss a return form, you can get a new one by contacting our customer service.

6.4. When you return or exchange an item , Pomme repays the amount you paid for the item, including shipping costs. Exceptions apply to any additional delivery costs as a result of choosing a different delivery method than the standard delivery offered by Pomme. If returning part of an order, the potential delivery cost is not refunded.

6.5. On the amount to be repaid, Pomme is entitled to deduct a sum corresponding to the devaluation of the goods compared to the original value of the goods if such devaluation is due to the fact that you have handled the goods to a greater extent than what’s necessary to determine its properties or function.

6.6. When exercising the return right, you pay the return freight. The goods come with a prepaid return shipping label to be used for returns. Thus, no return shipping cost will have to be paid at the time of submission of the return package, but the cost of the return will be regulated by deducting a fee from the refunded amount.

6.7. Pomme will repay the amount as soon as possible, but no later than 14 days from the date we received your return and sent you a return confirmation via email. The repayment will be made to you in the same payment option you choose when you purchased the item, provided that nothing else has been agreed or that there are barriers to such repayment.

7. Warranty and complaint
7.1. Some of Pomme’s products may be covered by warranty. Information about any warranty and special warranty conditions for the respective product will be found on the website. Warranty for goods only covers original manufacturing defects, and thus not errors caused by the use of the product. Your order confirmation is valid as proof of warranty.

7.2. The right of complaint covers goods that are incorrect in accordance with consumer protection legislation. If you find that the product is defective when you receive your order, you should contact Pomme as soon as the defect is discovered. You have a 3 year warranty on goods purchased on the Site.

7.3. Pomme covers the return shipping cost for approved complaints.

7.4. Once the product has been returned and the complaint is approved, Pomme will compensate you in accordance with applicable consumer protection legislation. Pomme strives for this to happen within 30 days of Pomme receiving the complaint, but it may take longer depending on the nature of the product. Pomme reserves the right to refuse a complaint if it turns out that the product is not in error in accordance with consumer protection legislation.

8. Links
8.1. Pomme can link to websites that are beyond Pomme’s control, and such websites can link to Pomme’s website. Although Pomme attempts to only interact with websites that share Pomme’s personal data and security regulations under the Privacy Policy, Pomme is not responsible for the protection or privacy of any personal information that you provide on other websites. You should exercise caution and read the personal data requirements for the website in question.

9. Force Majeur
9.1. Pomme is not responsible for delays caused by circumstances that Pomme could not control such as, for example, general labor conflict, war, fire, lightning strike, terrorist attack, changed government regulation, technical problems, electricity / telecommunications / data connections or other communications and errors or delays in subcontractor services due to circumstances stated herein. These circumstances shall constitute grounds for exemption which result in exemption from damages and other penalties. Should any such situation occur, Pomme informs you both at the beginning and at the end of the time of the situation. If the circumstance has been longer than two months, both you and Pomme have the right to cancel the purchase with immediate effect.

10. Changes to the Terms
10.1. Pomme reserves the right to make changes to these terms at any time. All changes to these terms will be published on the website. Changes apply from the acceptance of the Terms (in connection with a new purchase or when visiting the website), or 30 days after Pomme has informed you of the changes. However, Pomme recommends that you keep up to date on the website regularly to be aware of any changes to the terms.

11. Invalidity
11.1. If a court, authority or arbitration panel finds that any provision of these terms is invalid or unenforceable, that provision and all other provisions shall be valid and enforceable to the extent permitted by applicable law. The provisions declared invalid or unenforceable will be replaced by relevant legal guidance and advice.

12. Applicable law and dispute
12.1. Disputes should primarily be resolved in consensus after discussion with Pomme’s customer service.

12.2. If a dispute cannot be resolved in agreement with Pomme’s customer service, you as a customer can submit complaints directly online via the European Commission’s dispute settlement platform, which can be found at the following link https://ec.europa.eu/consumers/odr. If you submit a complaint through this platform, your case will automatically be forwarded to the appropriate nationally responsible dispute resolution body. This dispute settlement body then contacts us and tries to resolve the dispute without interfering with the court.

12.3. In the event of a dispute, Pomme follows a decision from the dispute resolution body.

12.4. Disputes concerning the interpretation or application of these terms shall be interpreted in accordance with Swedish law and shall be settled in accordance with clause 13.2 above or, ultimately, by a general court.
